Warranty Information

The terms below detail the intent of the warranty. When the full legal text is available this page will be updated with it and that is the warranty that will take effect. This may sound somewhat sketchy but the purpose of this page is to ensure you that there is an intent to offer a good warranty, it just takes time (and money) to have a lawyer draft one. I could have used a template for this but all of the templates I found were designed to disclaim as much as legally possible and offer as little protection to you as possible. So if I intended to do that I could have just used one of those.

What is below is the text that represents what the warranty that will be offered should do/cover. Effectively, it's what I'm sending the lawyer and saying, "Draft a warranty that does this." If you are concerned about this at all then I both understand and encourage you to wait until the full legal text is available.

Overview

A limited warranty is provided for some products sold by StarshadeRETRO. The length of the warranty and what is covered varies by product. For products with customizations, those customizations are also covered under the customization warranty. Products that are offered as services, such as battery replacement, are not covered by this warranty.

This section provides a quick explanation of the warranty below (a "TLDR"). This warranty generally:

  • ...disclaims all implied warranties to the extent permitted by law. In the event an implied warranty cannot be legally disclaimed it instead limits them to the duration of the warranty expressed below.
  • ...does not restrict your right to repair, service, or modify the things you own.
  • ...covers the cost of:
    • ...domestic shipping on products for 30 days (both directions).
    • ...domestic shipping back to you.
  • ...does not cover the cost of:
    • ...domestic return shipping (the cost from you to us) on products after 30 days.
    • ...international shipping (both directions).

  • Pre-assembled OSCRs
    • 1-year limited warranty on:
      • The LCD module.
      • Labor.
      • ...for HW5 REV5 or earlier:
        • The MEGA Embed/MINI module.
        • The clock generator module.
        • The CIC module.
      • ...for HW5 REV6 or later:
        • The mainboard and components, except the GBx slot.
        • The top PCB and components, except for the slots.
    • 30-day limited warranty on:
      • All other modules, components, accessories, and upgrades.
  • SD2SP2 Adapter
    • 3-year limited warranty.
  • OSCR CIC Module (Assembled)
    • 1-year limited warranty.
  • Custom Consoles:
    • GameCube:
      • Main unit:
        • 1-year limited warranty on:
          • The optical disc drive.
          • The main board.
          • The internal power supply.
        • 30-day limited warranty on:
          • All other parts.
      • Modules, accessories, and upgrades:
        • Manufacturer's 6-year full warranty:
        • 1-year limited warranty on:
          • Pluto IIx HDMI
          • Laser Bear x BlueRetro Internal Bluetooth Controller
          • Game Boy Player
          • OEM-branded external power supply
        • 30-day limited warranty on:
          • All other modules, accessories, and upgrades.
  • RetroSix-branded products, modules, accessories, and upgrades:
    • No warranty / All warranty service is provided at the discretion of RetroSix.
  • All other products offered on this storefront:
    • 30-day limited warranty.

Warranty Terms

Disclaimer of Implied Warranties

The foregoing warranties are exclusive and are in lieu of all other warranties whether written, oral, implied, or statutory.  EXCEPT AS OTHERWISE SPECIFICALLY SET FORTH HEREIN, SELLER MAKES NO REPRESENTATIONS AND EXTENDS NO OTHER WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, DESIGN, OUTPUT, THROUGHPUT, AND THE ABSENCE OF LATENT OR OTHER DEFECTS, WHETHER OR NOT DISCOVERABLE. WITHOUT LIMITING THE FOREGOING, ANY SOFTWARE SUPPLIED IS ONLY GUARANTEED TO OPERATE FREE OF ERRORS OR DEFECTS CAUSED BY SELLER.

What is covered:

  • Any defects or malfunctions in the covered items specified above for the duration specified.
  • The labor to replace or repair a covered item.
  • The labor to replace a part that is not covered within the duration of the overall unit when the replacement part is purchased from StarshadeRETRO.

What is not covered:

  • Normal wear and tear.
  • Cosmetic defects.
  • Physical damage, whether intentional or accidental.
  • Labor, parts, or other changes required/caused by firmware updates. Some examples of this:
    • If a firmware/software update requires a new wire or part to be installed, this is not covered.
    • If a firmware/software update fails and bricks the device then the device itself is not covered. Labor to recover/unbrick the device may be provided at no or reduced cost at the discretion of StarshadeRETRO.

Your responsibilities and what to do when a covered issue arises within the warranty period

  • While not required, it is highly recommended that you keep the original shipping/packing materials for the duration of the warranty period.
  • You must timely notify StarshadeRETRO of the issue. Notifications outside the warranty period are invalid even if the actual covered event occurred during the warranty period.
  • You should attempt any reasonable non-technical troubleshooting steps to try to remedy the issue. A reasonable troubleshooting step:
    • ...can be something such as removing an externally connected device, updating firmware or software to a specific version when the tools to do so are commonly available (i.e. a USB cable and a computer), etc.
    • ...may optionally require the removal of the top shell (i.e. if the fan dies, you may be asked if you can send only the fan back). Any request that requires disassembly will always be optional and up to the customer.
    • ...will never require removing the metal shielding or involve any soldering.
  • If the issue cannot be remedied through the troubleshooting process you will be assigned an RMA number and must return the product via a common or contract carrier (USPS, UPS, etc) to StarshadeRETRO.

How covered issues affect the warranty term:

  • If a part is replaced by StarshadeRETRO...
    • ...and is paid for by StarshadeRETRO: The warranty term remains unchanged and the replaced part is covered under the original warranty. That is to say that the warranty duration is not extended or reset.
    • ...and is paid for by the customer: The part will receive a warranty that is the greater of:
      • The original warranty period of that part.
      • A period of time, if any, that is offered with the part when purchased from StarshareRETRO standalone.

When an issue is not covered:

  • When an issue arises that is not covered under this policy StarshadeRETRO may still service the item for a fee to be determined at the time of contact.

Shipping details and who pays for shipping:

  • For all returns:
    • StarshadeRETRO is not responsible for any damage in transit.
    • If you use a label provided by StarshadeRETRO and additional shipping charges are incurred you will be responsible for these charges and will need to pay them before the item will be returned to you.
      • You will not be charged if you are returning an item using the original shipping materials unless you include something that you were not asked to include, such as a power supply, game, etc.
      • This should only happen if the shipping details, such as the dimensions or weight, that you provided were inaccurate. These charges are levied by the shipping company.
  • For domestic (within the US) returns:
    • If you have the original packing materials:
      • Within 30 days of purchase: StarshadeRETRO will provide a shipping label via PDF. You will be responsible for correctly repackaging the product and placing the label on the package.
      • After 30 days: You may either use and pay for a shipping service of your choice or purchase a label (provided as a PDF) from StarshadeRETRO.
      • In both cases, as long as a covered defect is found, StarshadeRETRO will return the item at no additional cost. If a covered defect is not found you will be responsible for return shipping charges.
    • If you do not have the original packing materials:
      • You may either use and pay for a shipping service of your choice or purchase a label (provided as a PDF) from StarshadeRETRO.
      • As long as a covered defect is found, StarshadeRETRO will return the item at no additional cost. If a covered defect is not found you will be responsible for return shipping charges.
  • For international (outside the US) returns:
    • You must pay for shipping to and from StarshadeRETRO for warranty service.
  • Warranty service may not be available if your address is not serviceable by StarshadeRETRO.
    • For instance, if you lived in Russia and ordered something before the sanctions on Russia there would be no way for us to send the item back to you as our shipping provider is no longer servicing Russia.
